Through the analysis of CCTV footage from nearby areas, the Siliguri police were able to apprehend a 22-year-old man named Mohammad Abbas in connection with the heinous crime. Abbas, who was arrested in Lenin Colony, Siliguri, is believed to have lured the victim to an abandoned building with the intention to rape her. When she resisted, he viciously attacked her with a brick, leading to her death.

Residents of the area expressed shock and dismay at the brutal crime. The victim was described as a bright student who actively participated in school activities, including cultural programs. Authorities have confirmed that Abbas has a criminal record, having previously been involved in a rape case.
In response to the incident, members of local voluntary organizations, such as Siliguri Narishakti and Bajrang Dal, gathered outside the court premises to protest and demand justice for Diya. They called for Abbas to be hanged in public after a speedy trial in a fast-track court. Concerns were expressed about the rise of “Love Jihad” and the victimization of Hindu girls without adequate checks.
